summary

By Resolution of September 9, 2014, of the Presidency of the State Tax Administration Agency, established the structure of the area of ​​human resources and economic management of the Agency's territorial organization. The evolution experienced since then by the organization of the State Tax Administration Agency aims to promote administrative policies that increase efficiency in the provision of public services.

In fact, as this resolution aims to optimize, from a functional point of view, the coordination of certain administrative procedures and flexibility in the assignment of tasks between the different units. To this end, from the organizational point of view, the possibility of advancing in the simplification of structures is foreseen at the regional level, with the implementation of a regionalized organization compatible with the establishment, at the central level, of decentralized offices, taking advantage of the synergies provided by electronic media, all with the aim of increasing efficiency in the operation of the organization in the area.

By virtue of the above and in use of the authorization conferred by the fifteenth section of the Order of June 2, 1994, issued in development of number 5 of section eleven of article 103 of Law 31/1990, of December 27, of General State Budgets for 1991, by which the President of the State Tax Administration Agency is empowered to dictate normative resolutions that structure and attribute powers to the bodies of the Special Delegations and Delegations of the Tax Agency, as for structure, attribute competence, create, consolidate or eliminate said Delegations, I have:

First. Regional Units of Human Resources and Economic Management.

1. In the Special Delegations of the State Tax Administration Agency there is a Regional Unit for Human Resources and Economic Management which, under the dependence of the head of the Special Delegation, in accordance with the criteria and instructions issued by the Department of Human Resources and the Economic Management Service, exercise in its territorial scope, in the terms established in this resolution, the functions corresponding to human resources and economic management.

2. The Department of Human Resources or the Economic Management Service may exercise, on their own initiative, the functions, among those contained in the second section, that they determine to carry out centrally, for technological reasons, of greater efficiency or that persiganum greater economies of scale.

3. The Regional Unit for Human Resources and Economic Management will extend its competence to the territorial scope of the corresponding Special Delegation, and the units in which it is organized, whatever their headquarters, may carry out their actions throughout this territorial scope, prior authorization, depending on the nature of the action in question, from the Department of Human Resources or the Economic Management Service.

4. Exceptionally, by express agreement of the head of the Human Resources Department or the head of the Economic Management Service, in their respective fields of action, the functions listed in this resolution may be extended outside the territorial scope of the Special Delegation.

5. The Regional Unit for Human Resources and Economic Management may have, under the terms established by the list of jobs, functional units specialized in matters that are the object of its competence. In any case, the competences that require a specific professional qualification for their exercise will be carried out through functional units made up of specialized personnel who have said qualification.

6. The direction, supervision and coordination of all the functions assigned to the Regional Unit for Human Resources and Economic Management corresponds to the Head of the Regional Unit.

Second. Functions of the Regional Units of Human Resources and Economic Management.

The Regional Human Resources and Economic Management Units are responsible for exercising the functions entrusted to them in their territorial scope in terms of human resources and economic management, in accordance with the action criteria established by the Human Resources Department or by the Economic Management Service, including in particular the following:

  • 1. In the field of Human Resources:
    • a) Process personnel procedures, in accordance with the powers attributed in said matter to the different bodies of its territorial scope.
    • b) Collaborate in the processing of personal procedures that are managed centrally.
    • c) Coordinate trade union and labor relations within the scope of the Special Delegation.
    • d) Develop the established occupational risk prevention policies in its field and coordinate whatever actions are available in this area.
    • e) Collaborate, with respect to personnel assigned to their territorial area, in the execution of risk analysis action plans and training, selection, social action, equality and other human resource policies.
  • 2. As part of Economic Management:
    • a) Process the economic-financial management procedures related to the competences that in this matter correspond to the administrative bodies of the Special Delegation and its Delegations.
    • b) Coordinate and manage the safety of people and work centers, the operation of the records in their area, the management of files and general services, and manage the material means available for compliance with the Agency's fines and objectives.
    • c) Coordinate and check the correctness of the accounting of state taxes and resources of other Administrations and Public Bodies managed by the Agency.
    • d) Manage, write projects, exercise the facultative directions and the control and follow-up of the execution of the contracts for works and services associated with them, in accordance with the planning of actions and the directives issued by the Economic Management Service.
    • e) Property management, maintenance and upkeep of real estate located in its territorial scope, as well as planning, evaluating and controlling its budgetary needs.
    • f) The management and development of tasks, expert reports and other technical actions with tax implications, as well as the management of other technical-optional support services in real estate matters.

Third. Decentralized headquarters of the Regional Units of Human Resources and Economic Management in the Agency's Delegations.

1. Prior authorization from the Human Resources Department or the Economic Management Service, depending on the nature of the function in question, there may be decentralized offices of the Regional Human Resources and Economic Management Units located in the Tax Agency Delegations. , and they are responsible for exercising the functions of the Regional Unit for Human Resources and Economic Management in the Delegation and in the Administrations or other territorial bodies located at the headquarters, or those expressly provided by the Head of the Regional Unit.

2. The direction, supervision and coordination of the Human Resources and Economic Management units and the personnel belonging to them existing in the Tax Agency Delegations, under the leadership of the Delegate, will be in charge of the Head of the Regional Human Resources Unit. and Deputy Economic Management or the Secretary General than the Head of the Regional Unit, without prejudice to the superior coordination of the latter and the powers that correspond to the Special Delegates and Delegates of the Tax Agency.

Fourth. Decentralized headquarters of the Regional Units of Human Resources and Economic Management in the Administrations of the State Tax Administration Agency or other territorial bodies.

Prior authorization from the Department of Human Resources or the Economic Management Service, depending on the nature of the function in question, in the Administrations of the State Tax Administration Agency, or other territorial bodies, decentralized offices of the Regional Units of Human Resources and Economic Management that, under the leadership of the head of the urgano-territorial Administration and the coordination of the Head of the Regional Unit or Secretary General, may perform the functions listed in the Second section, in accordance with the instructions determined by the Head for that purpose. of the Regional Unit for Human Resources and Economic Management.

In those local government administrations in which there are no Human Resources and Economic Management personnel, the functions related to this area will be carried out by the Administrator or the person designated by him.

Single transitory provision Transitional regime for affected personnel

The functions and other personnel that are affected by the organic modifications agreed in this Resolution will receive all of their remuneration charged to the credits of the budget of the State Tax Administration Agency, in accordance with what is established for the job they were performing. according to the list of jobs approved at the date of entry into force of the Resolution and as long as it is not modified or readscripted to the affected jobs.

As long as the list of jobs is not adjusted, the functions of the territorial bodies of human resources and economic management will be carried out by the currently existing bodies.

Repealing provision only resolution that remains without effect

The Resolution of September 9, 2014 of the Presidency of the State Tax Administration Agency, by which it establishes the structure of the area of ​​human resources and economic management of the territorial organization of the Agency, remains without effect.

FINAL PROVISIONS

First final provision No increase in public spending

The approval of this Resolution does not imply an increase in public spending in the budgets of the State Tax Administration Agency.

Second final provision Entry into force

This resolution will enter into force the day after its publication in the Official State Gazette.
