The Resolution of December 10, 2020, of the General Directorate of Civil Aviation, which publishes the Technical Instructions for the safe transport of dangerous goods by air (ICAO Document 9284/AN/905), 2021-2022 edition, establishes in chapter 4, part 1, of its Annex, various aspects of the instruction on dangerous goods.

A safe and efficient transportation system depends on the competence of its personnel, which is why this regulation states that the employee must ensure that the personnel are competent in the performance of any function for which he is responsible, before he proceeds to confuse . This objective must be achieved through training and evaluation that correspond to the functions for which the personnel in question are responsible.

A Competency-Based Approach to Training and Assessment (CBTA) ensures that staff know what tasks they are expected to perform competently, and that those who train and assess know what performance to train and assess.

Specifically, point 4.6, of chapter 4, of part 1, related to Qualifications and competencies of instructors, establishes that instructors in charge of initial and refresher training programs on dangerous goods must test or be evaluated to demonstrate their competence. pedagogical competence and in the function about which they are to provide instruction before proceeding to provide such instruction.

Therefore, by virtue of the provisions of article 9 l) of the Statute of the State Air Safety Agency approved by Royal Decree 184/2008, of February 8, this State Air Safety Agency resolves:

First. Object.

Establish the minimum requirements for the qualification of instructor/assessor personnel assigned to Training Programs in Dangerous Goods by each area for which approval is requested, except for air operators.

Second. scope.

This resolves to be applicable to the instructor/evaluator staff attached to Training Programs in Dangerous Goods by area of ​​those recipients whose personnel performed functions aimed at ensuring that dangerous goods are transported in accordance with the Technical Instructions for the safe transport of dangerous goods by via air (ICAO Document 9284/AN/905) and that request an approval of Instruction Programs for the Safe Transport of Dangerous Goods by Air via competency-based training (CBT), except for air operators.

Third. General requirements of the instructor/assessor personnel assigned to Training Programs in Dangerous Goods by air.

Instructors in charge of initial and refresher training programs on dangerous goods must test or be evaluated to demonstrate their pedagogical competence and in the function on which they are to provide training before proceeding to impart said training. By extension, the same requirements will apply to evaluators.

Instructors responsible for providing initial and refresher training on dangerous goods must teach such courses at least every 24 months or, if that is not the case, will attend refresher training sessions.

a) Pedagogical Competence:

Certificate of having received training in pedagogical skills or,

Prove the passing of:

1. Attendance has a course as an observer.

2. Preparation and delivery of a supervised course for another instructor.

– Certificate accrediting the instruction received.

– Evidence of having carried out the instruction.

b) Knowledge of dangerous goods in force, in the function that they are going to teach/assess:

Have received instruction in dangerous markets in the last 24 months in the function about which they are going to provide instruction before proceeding to impart it.

– Evidence of having passed the required instruction (certificate proving that it has been evaluated as competent) or,

– Evidence of having successfully passed an exam in the corresponding category before 31-12-2022 in force, according to the category-based instruction system.

c) Professional experience of 6 months in the function that they are teaching/evaluating obtained during the last 5th of August(1).

In cases where the role of an instructor is changed, those instructors who have proven experience in the same operational environment may instruct once they are assessed for competency with respect to the new roles. If proficiency cannot be demonstrated, additional appropriate training must be given.

– Employee certificate accrediting professional experience in the function and including a description of the position, for the required period.

– Certificate of having passed the corresponding evaluation and, where appropriate, additional instruction.

Maintaining competencies of instructors/evaluators.

They must teach such courses at least every 24 months or, if that is not the case, they will attend refresher training sessions.

– Evidence of having taught said courses or, certificate proving that they have been evaluated as competent after the review instruction, in the required period.(1) Except for those instructors/evaluators with powers to act as such in the function they are going to impart. /assess, valid until the entry into force of the new competency-based training provisions.

Fourth. Instructors/Assessors with privileges before January 1, 2023.

All those instructors/assessors with powers to practice as such in the 24 months prior to the entry into force of the new competency-based training and assessment provisions, may instruct and assess in the function for which they are qualified and valid for up to 24 months. months since their last instruction and evaluation.

Provide instruction in different functions for those who are capable, they tend to be able to be evaluated for demonstration of competence in the specific function of which they are going to give instructions to proceed with the assignment, in accordance with the points in table A) of section previous.

Fifth. effects

This resolves to take effect the day following its publication in the Official State Gazette and as long as it is maintained, in the subsequent editions of the Technical Instructions for the safe transport of dangerous goods by air (ICAO Document 9284/AN/905), the content of section 4.6 regarding the Qualifications and skills of the instructors included in the 2021-2022 edition.

Sixth. Advertising.

This Resolution or any of its modifications must be made public in the Official State Gazette and on the AESA website.

In the face of this Resolution, which puts an end to the administrative proceeding, a contentious-administrative appeal may be filed within a period of two months from its publication, before the Central Contentious-Administrative Courts, in accordance with the Article 46 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
