Both the “early warnings” Directive and the Consolidated Text of the Bankruptcy Law and its jurisprudential development focus on solutions to the insolvency situation. But, the sad reality is our evidence that the mayor leaves the company in trouble, they do not achieve a solution and it ends in liquidation without the sale of the productive unit, loss of business value, job losses and resulting in a dominated effect in the case of those sectors, especially affected.
It follows that, on more occasions than delays, the lack of resolution is due precisely to a loss of anticipation on the part of the company, to a lack of knowledge of the solutions that are available or to the stigma itself that carries a competitive risk or pre-competitive situation. This Specialization Program, unlike others, focuses on the English concept of "turnaround" or business recovery. And, for this reason, our training will focus on the various solutions that companies have in a situation of treasury stress: options outside the framework of bankruptcy proceedings such as refinancing agreements (or restructuring plans, as defined by the imminent reform that we are waiting for), the traditional creditor agreement (with special emphasis on the early proposal) or the liquidation, with special emphasis on maintaining the business through the sale of the production unit (both initially -prepack- and throughout of the entire bankruptcy proceeding).
Our students who follow our Specialization Courses consider the methodology followed essential for their use. Availability of basic contents that are facilitated with access to the Intelligent Digital Library together with complementary contents as part of the constant revitalization that is carried out, to which the final sentences and resolutions on the matter are added.
In the methodology of the "Specialization Program on insolvency: business restructuring and other solutions" we consider essential the possibility of participating in the 5 Digital Meetings, one for each Module, where the professors, José Carles Delgado and Carlos Cuesta Martín, resorting to the methodology of the case they will share their experience and experience with the students who will have the possibility of planting all those doubts and concerns that arise in their professional performance. Opportunity that they will also have recurrent availability at any time to the Teacher Follow-up Forum.
We want the students to have some training resources at the end of the Program that they will use to face their professional performance, such as the basic and complementary materials, the interventions in the Forum with the dynamization and resolution of doubts, the videos of the Digital Meetings together with the Video that accompanies this Module with the most outstanding aspects and a final video of the Course synthesizing the «keys» after its follow-up. In short, a training that stays with the students...
