Having seen and examined the Amendments to Annexes I and II to the Protocol to the 1979 Convention on long-range transboundary air pollution caused by persistent organic pollutants, adopted in Geneva on December 18, 2009 by Decision 2009/2.

Granted by the Cortes Generales the authorization provided for in article 94.1 of the Constitution,

I express the consent of Spain to be bound by said amendments and issued the present instrument of acceptance signed by M and countersigned by the Minister of Foreign Affairs and Cooperation,

AMENDMENTS TO ANNEXES I AND II TO THE PROTOCOL TO THE 1979 CONVENTION ON LONG-RANGE TRANSBOUNDARY AIR POLLUTION CAUSED BY PERSISTENT ORGANIC POLLUTANTS

Inclusion of short-chain chlorinated paraffins and polychlorinated naphthalenes in Annexes I and II of the 1998 Protocol on persistent organic pollutants

The Parties to the 1998 Protocol on Persistent Organic Pollutants, meeting at the twenty-seventh session of the Executive body,

Decides to amend the 1998 Protocol to the Convention on Long-Range Transboundary Air Pollution by Persistent Organic Pollutants (the POPs Protocol) as follows:

Article 1 Modify

A. Annex I.

1. The following substances are added by inserting the following rows in the proper alphabetical order:

Polychlorinated naphthalenes (PCN).Production.None.Use.None.Short-chain chlorinated paraffins).Production.None, except in the case of production for the uses specified in Annex II.Use.None, except in the case of the uses specified in Annex II.

2. At the end of the annex, the following footnote is added:

d) Short-chain chlorinated paraffins are understood to be chlorinated alkanes with chain lengths of 10 to 13 carbon atoms and a degree of chlorination greater than 48% by weight.

B. Annex II.

1. The following substance is added by inserting the following row in the proper alphabetical order:

Cut-chain chlorinated paraffins).

a) flammable substances in the rubber used in conveyor belts in the mining industry;

b) Fireproof substances in paradic chairs.

Parties must take steps to eliminate these uses when suitable alternatives become available.

Subsequently in 2015, and every four years thereafter, each Party using these substances must report on progress made towards their phase-out and submit information on such progress to the Executive body. Sober the base of unformed stories, to reassess these restricted uses.

2. At the end of Annex II, the following footnote is added:

b) Short-chain chlorinated paraffins are understood to be chlorinated alkanes with chain lengths of 10 to 13 carbon atoms and a degree of chlorination greater than 48% by weight.

Article 2 Relationship with the POPs protocol

No State or regional economic integration organization may deposit an instrument of acceptance of this amendment unless it has previously, or simultaneously, deposited an instrument of ratification, acceptance or approval of, or accession to, the POPs Protocol.

Article 3 Entry into force

1. Pursuant to Article 14(3) of the POPs Protocol, this amendment shall enter into force on the ninetieth day after the date on which two thirds of the Parties to that Protocol have deposited with the Depositary their instruments of acceptance of it.

2. After the entry into force of this amendment in accordance with paragraph 1, it shall enter into force for any other Party to the Protocol on the ninetieth day from the date on which its instrument of acceptance was deposited.

Switzerland will approve future amendments to the Protocol in the framework of a normal ratification procedure, as up to now, on the basis of Article 3(16) of the Protocol.

This Amendment will enter into force, in general and for Spain, on February 26, 2023, in accordance with the provisions of paragraph 3 of article 14 of the Protocol.
