RESOLUTION MEPC.331(76) AMENDMENTS TO THE INTERNATIONAL CONVENTION ON THE CONTROL OF HARMFUL ANTI-FOUL SYSTEMS ON SHIPS, 2001

Modifications to annexes 1 and 4

(Control measures for cibutrin and model of International Certificate related to the antifouling system)

The Committee for the Protection of the Marine Environment,

Recalling article 38 a) of the Constitutive Convention of the International Maritime Organization, article that deals with the functions of the Committee for the Protection of the Marine Environment conferred by the international conventions related to the prevention and containment of marine pollution caused by ships,

Recalling also article 16 of the International Convention on the Control of Harmful Anti-fouling Systems on Ships, 2001 (AFS Convention), which stipulates the amendment procedure and confers on the Marine Environment Protection Committee of the Organization the function to consider amendments to said Convention for adoption by the Parties,

Having considered, at its 76th session, the proposed amendments to the AFS Convention on Control Measures for Cybutrin and the Model International Anti-fouling System Certificate,

1. Adopts, in accordance with the provisions of Article 16(2)(c) of the AFS Convention, the amendments to Annexes 1 and 4, the text of which is set out in the Annex to the present resolution;

2. Determines, in accordance with the provisions of article 16 2) e) ii) of the AFS Convention, that the amendments will be considered accepted on July 1, 2022 unless, before that date, more than one third of the Parties have notified the Secretary General that they reject the amendments;

3. Invites the Parties to note that, pursuant to Article 16(2)(f)(ii) and iii) of the AFS Convention, these amendments shall enter into force on January 1, 2023, a Once accepted in accordance with the provisions of paragraph 2 above;

4. Also invites Parties to remind ships flying their flags, and confirmed to be affected by the amendments to Annex 1 of the AFS Convention by this Resolution, to apply in a timely manner for filing acknowledgment of an International Anti-fouling System Certificate, using the model adopted by this resolution, in accordance with the procedure described in paragraphs 4 and 5.3 of the annex to resolution MEPC.195(61), as may be amended by the Organization, so that ships have on board a valid International Anti-fouling System Certificate no later than 24 months after the entry into force of the amendments to Annex 1 of the AFS Convention adopted by this Resolution;

5. Further invited the Parties to issue the new International Anti-fouling System Certificate, using the amended model adopted by this resolution, the next time it applies an anti-fouling system, in the case of ships for which it is confirmed that they are not affected by the amendments to annex 1 of the AFS Convention adopted by this resolution;

6. Requests the Secretary-General, for the purposes of article 16(2)(d) of the AFS Convention, to transmit certified copies of this resolution and the text of the amendments contained in the annex to all Parties to the AFS Convention;

7. Also requests the Secretary-General to transmit copies of this resolution and its annex to Members of the Organization that are not Parties to the AFS Convention;

8. Further requests the Secretary General to prepare the consolidated certified text of the AFS Convention

APPENDIX 1
Control measures for antifouling systems

1. The following rows are added to the table in Annex 1 of the 2001 AFS Convention:

1) remove the antifouling system; and.

2) Apply a coating that forms a barrier that prevents the leaching of this substance present in the unauthorized antifouling system that is located below.

All ships except:

1) Fixed and floating platforms, UFAs and FPAD units built before January 1, 2023 and not in dry dock on or after January 1, 2023;

2) vessels that do not carry out international voyages; and.

3) Vessels of less than 400 gross tonnage that make international voyages, if accepted by the coastal State or States.

At the next scheduled system refresh.

Surveys and certification requirements for antifouling systems

2. Replace setting 2 3) with the following text:

3) For ships that have an anti-fouling system subject to one of the control measures indicated in annex 1 that has been applied before the entry into force of that measure, the Administration will issue a Certificate in accordance with the provisions of paragraphs 1 and 2 of this regulation no later than two years after the entry into force of said measure. The provisions of this paragraph shall not affect any requirement that ships comply with the provisions of Annex 1.
