2021 Amendments to the International Code on the Program

RESOLUTION MSC.483(103) (adopted May 13, 2021) AMENDMENTS TO THE INTERNATIONAL CODE ON THE ENHANCED PROGRAM OF INSPECTIONS DURING SURVEYS OF BULK CARRIERS AND OIL TANKERS, 2011 (2011 ESP CODE)

The Maritime Safety Committee,

Recalling article 28 b) of the Convention establishing the International Maritime Organization, article dealing with the functions of the Committee,

Recalling also resolution A.1049(27), by which the Assembly adopted the International Code on the Enhanced Program of Inspections During Surveys of Bulk Carriers and Oil Tankers, 2011 (the 2011 ESP Code), which has become mandatory under the chapter XI-1 of the International Convention for the Safety of Life at Sea, 1974 (the Convention),

Further recalling Article VIII b) and Rule XI-1/2 of the Convention, regarding the procedure for amending the 2011 ESP Code,

Having considered, at its 103rd session, the amendments to the 2011 ESP Code proposed and circulated in accordance with the provisions of Article VIII b) i) of the Convention,

1. Adopts, in accordance with the provisions of article VIII b) iv) of the Convention, the amendments to the 2011 ESP Code, the text of which appears in the appendix to this resolution;

2. Decides, in accordance with the provisions of Article VIII b) vi) 2) bb) of the Convention, that such amendments shall be deemed accepted on July 1, 2022, unless, before that date, more than one third of the Contracting Governments to the Convention or a number of Contracting Governments whose combined merchant fleets represent at least 50% of the gross tonnage of the world merchant fleet, have notified the Secretary General that they object to the amendments;

3. Invites the Contracting Governments to the Convention to note that, in accordance with the provisions of Article VIII b) vii) 2) of the Convention in January, the amendments in force on 1 November 2023, once accepted in accordance with the provisions of paragraph 2 above;

4. Requests the Secretary-General, for the purposes of Article VIII(b)(v) of the Convention, to transmit certified copies of this resolution and the text of the amendments contained in the annex to all Contracting Governments to the Convention;

5. Also request the Secretary General to transmit copies of this resolution and its appendix to the Members of the Organization that are not Contracting Governments to the Convention.

Minimum prescriptions applicable to hopeful medicines that are carried out during renewal surveys of double-hull tankers

1. In the table of Minimum requirements applicable to thickness measurements that are made during renewal surveys of double-hull oil tankers, the column corresponding to renewal survey No. 1 is modified, so that it reads:
