Approved by the Government of Aragon, on February 22, 2023, Agreement granting express and formal approval, and ratifying, the Administration-Trade Union Agreement of February 17, 2023, for the harmonization of the electoral process to representatives of the personnel at the service of the General Administration of the Autonomous Community of Aragon, in August 2023, the publication is carried out in the terms indicated below.

AGREEMENT OF FEBRUARY 22, 2023, OF THE GOVERNMENT OF ARAGN, GRANTING EXPRESS AND FORMAL APPROVAL, RATIFYING IT, TO THE ADMINISTRATION-TRADE UNIONS AGREEMENT OF FEBRUARY 17, 2023, FOR THE HARMONIZATION OF THE ELECTORAL PROCESS TO REPRESENTATIVES OF STAFF AT THE SERVICE OF THE GENERAL ADMINISTRATION OF THE AUTONOMOUS COMMUNITY OF ARAGN, IN AO 2023
Union elections planned for representatives of the personnel that these services in the General Administration of the Autonomous Community of Aragon, where appropriate, will establish a common framework of action that facilitates the practice of the electoral process.
Based on this, the Government of Aragon and the CCOO, UGT and CSIF Trade Unions have signed an agreement to harmonize the development of the electoral process in the sectoral scope of the General Administration of this Autonomous Community.
By virtue of it, at the proposal of the Minister of Finance and Public Administration and after deliberation, the Government of Aragon at its meeting on February 22, 2023, agrees:
First.- Grant express and formal approval, ratifying it, to the Administration-Trade Union Agreement of February 17, 2023, for the harmonization of the electoral process to representatives of the personnel at the service of the General Administration of the Autonomous Community of Aragon, in the year 2023, which is attached as an annex to this Agreement.
Second.- Order its publication in the "Official Gazette of Aragon", in accordance with the provisions of article 38.6 of the consolidated text of the Law on the Basic Statute of Public Employees.
ANNEXED
ADMINISTRATION-UNIONS AGREEMENT OF FEBRUARY 17, 2023, FOR THE HARMONIZATION OF THE ELECTION PROCESS FOR REPRESENTATIVES OF PERSONNEL AT THE SERVICE OF THE GENERAL ADMINISTRATION OF THE AUTONOMOUS COMMUNITY OF ARAGN, IN THE YEAR 2023
Union elections planned in the terms of the provisions of the revised text of the Law of the Basic Statute of Public Employees, approved by Royal Legislative Decree 5/2015, of October 30, in the revised text of the Law of the Workers' Statute, approved by Royal Legislative Decree 2/2015, of October 23, and in Law 9/1987, of June 12, on representative bodies, determination of working conditions and participation of personnel at the service of Public Administrations, the The Autonomous Administration and the Trade Union Organizations with sufficient presence in it and with the capacity to promote its celebration, CCOO, UGT and CSIF, consider it opportune to establish an agreement that will facilitate the practice of the electoral process as a whole. For this reason, and after the appropriate deliberations and negotiations, they reach the following agreements, applicable between the signatory parties in those points that compete with them and as a suggestion to the Electoral Tables in everything that the legislation attributes to them.
First.- Application.
This Agreement shall be binding on the signatory parties. The components of the polling stations must consider it as a suggestion in all those aspects that are within their competence, according to the current legislation in this regard.
Second.- Object.
The object of this Agreement is the regulation of those aspects that the electoral norms have not contemplated, as complementary to others that are left to the will of the different actors in the process.
Third.- Electoral calendar.
In order to achieve harmonization and homogeneous operation of all the polling stations in terms of meeting deadlines, an electoral calendar is established which appears in Annex I of this Agreement, promoted to the personnel of the General Administration sectoral level of the Administration. of the Autonomous Community of Aragon, exclusive of the personal work of the Aragons Health Service.
In addition, the parties undertake to apply the provisions of article 67.2 of the Workers' Statute in the event of a concurrence of promoters.
Fourth.- Union rights and guarantees.
1. For an adequate fulfillment of the obligations and duties that the current legislation indicates to the Union Organizations in the electoral process, these may designate a number of people who will be sealed below and who will be excused from attending work in the periods marked:
Three people for the CCOO and two people for the UGT and CSIF, from the day after the ratification, by the Government of Aragon, of this Agreement until the day after the vote, both inclusive.
One person for each Trade Union Organization signed in each of the three provinces hanging the period previously expressed.
2. The waiver request must be communicated to the General Directorate of Public Function and Quality of Services and to the person in charge of the work center where the person to be waived is assigned.
3. The dispensation was granted automatically on the third business day from the entry of the corresponding request in the records of the governing bodies sealed in the previous section.
4. In everything else not expressed in this agreement, these waivers will have the same treatment as that provided for the rest of the waivers.
5. As regards the assemblies regime, it is established that, from zero hours of the day following the promotion of union elections until twenty-four hours of the day before the day of reflection, the signatory Union Organizations may hold assemblies in relation to elections, both aimed at staff and affiliates, without the need for authorization by the General Directorate of Public Function and Quality of Services.
The convening Union Organization must communicate this fact four business days prior to the date of holding the assemblies to the General Directorate of Public Function and Quality of Services and to the person in charge of the center or centers affected. In case of coincidence with the celebration of other union assemblies, you can modify the call up to twenty-four hours before the date of its celebration.
In any case, to guarantee the provision of the service, without prejudice to the right of assembly of those summoned.
Fifth.- Voting hours.
In order to facilitate the act of voting for all employees of the Administration of the Autonomous Community of Aragon, the following voting hours are established:
From 8:00 am to 6:30 pm
The Electoral Board will ensure that no one votes outside the sealed hours.
Sixth.- Distribution of polling stations.
1. The rationalization of the electoral process entails an analysis in view of the labor and functional census, of the geographical distribution of the Administration of the Autonomous Community of Aragon. For this reason, once this study has been carried out, an agreement has been reached on the distribution of the different polling stations, both for labor personnel and for civil servants.
This distribution is contained in annex II for the staff in the field of General Administration of the Autonomous Community of Aragon.
2. In application of the provisions of the Regulation for elections to representative bodies of workers in the company, approved by Royal Decree 1844/1994, of September 9, and in Regulation 1846/1994, of September 9, which approves the Regulations for elections to representative bodies of the personnel at the service of the General State Administration, includes the existence of a central electoral table or coordinator, for each electoral unit, with the functions that are sealed in them .
In addition to these functions, the act of constitution of these polling stations may grant them others of similar content and that refer to the entire electoral unit as a whole.
Seventh.- Electoral colleges.
The Workers' Statute, in what refers to the elections of labor personnel, creates two electoral colleges, on the one hand, that of technicians and administrators and, on the other hand, that of specialists and unqualified. However, it is not specified which professional categories are included in each one.
Therefore, the following distribution is agreed:
- College of Technicians and Administrative: Groups A, B and C of the VII Collective Agreement of the General Deputation of Aragon.
- College of Specialists and Unqualified: Groups D and E.
Eighth.- Composition of the polling stations for the election of representative bodies for the workforce.
They will be exempt from being part of the polling stations for the election of representative bodies for the workforce, workers who are temporarily disabled for a period of more than three months, as well as partial retirees.
Ninth.- Complaints to the electoral roll.
Public employees and union organizations can understand the inclusion of people in the census of the electoral correspondent desk either through the lists that are displayed on the bulletin boards of the work centers, or through the Employee Portal . In the event of observing any substantial error that modifies the registration to the corresponding polling station or the non-inclusion in the census, such as errors in the personal data that prevent the correct identification of the voter before the polling station, a claim may be filed, within the periods that is marked in annex I, through the Employee Portal or in the email address [email protected]
Tenth.- I vote by mail.
In accordance with the provisions of articles 19 of the Regulations for elections to the representative bodies of the staff at the service of the General State Administration, approved by Royal Decree 1846/1994, of September 9, and article 10 of the Regulations for elections To the representative bodies of the workers in the company, approved by Royal Decree 1844/1994, of September 9, the desire to vote by mail may be communicated to the polling stations.
When such communications are seen before their constitution, they will be collected by the respective coordinators, in accordance with the provisions of the Order on criteria for action in the process of union elections for Personnel Boards, Company Committees and Personnel Delegates in The scope of the General Administration of the Autonomous Community of Aragon to be held on May 10, 2023, which will deliver them to the Tables as soon as they are constituted.
Eleventh.- Electoral Units.
The name of the electoral units is determined in Annex III
Twelfth.- Support for polling stations.
The Administration will provide the polling stations with the necessary administrative support for the best development of their functions and guarantee compliance with the deadlines.
