CULTURAL AND EDUCATIONAL COOPERATION AGREEMENT BETWEEN THE KINGDOM OF SPAIN AND THE REPUBLIC OF SENEGAL

The Kingdom of Spain and the Republic of Senegal, hereinafter referred to as the Parties,

Desiring to develop and strengthen friendly relations between the two countries,

Recognizing the important role that intercultural dialogue plays in bilateral relations,

Convinced that exchanges and cooperation in the fields of education and culture will contribute to a better understanding of their respective societies and cultures,

They have agreed to the following:

Article 1

The parties will exchange their experiences and information regarding the policies of the two countries in cultural matters.

Article 2

Las Parts promotes cooperation between cultural institutions through agreements between museums, libraries, archives, cultural heritage institutes and theaters.

Article 3

The Parties promote the organization of conferences, symposia and colloquiums of experts within the framework of academic cooperation between past backs and favoring the exchange of students, professors and researchers in the field of culture and art.

Article 4

The parties will promote the exchange of experiences in the field of the creation and management of Cultural Centers in foreign countries and will study the possibility of creating such centers in both countries.

Article 5

The Parties promote the organization in the course of cultural activities, as well as participation in art exhibitions and cultural promotion activities, including creative and cultural industries.

Article 6

Both Parties will study ways of cooperation in the field of protection of cultural heritage, restoration, protection and conservation of historical, cultural and natural sites, with special emphasis on the prevention of illicit trafficking in cultural property according to their respective national legislation, and in accordance with the obligations derived from the International Conventions signed by both countries.

Article 7

Each Party guarantees, within its territory, the protection of the intellectual property rights and related rights of the other Party, in accordance with the legislation in force in their respective countries.

Article 8

The Parties collaborate in the field of libraries, archives, the publication of books and their dissemination. Exchanges of experiences and professionals in these sectors (eg documentalists, archivists, librarians) will also be encouraged.

Article 9

The Parties promote participation in international music, art, theater and film festivals held in both countries, upon invitation, in accordance with the terms and conditions imposed by the organizers of the festivals.

Article 10

Both Parties will foster the development of relations between their respective pasts in the field of education:

  • a) facilitate cooperation, contacts and direct interactions between institutions and organizations responsible for education in the past;
  • b) facilitating the study and teaching of the languages ​​and literature of the other Party.

Article 11

Both Parties will study the necessary conditions to facilitate the mutual recognition of titles, diplomas and academic degrees, in accordance with the provisions of their respective internal legislation.

Article 12

Both Parties will promote the exchange of textbooks and other sober didactic materials on history, geography, culture and social and economic development, as well as the exchange of courses, study plans and didactic methods published by the educational institutions of the two countries.

Article 13

Both Parties will encourage contacts between youth organisations.

Article 14

Both Parties promote cooperation between deported organizations, as well as participation in the deported events that will take place in each of the two countries.

Article 15

Expenses that may arise from the execution of the Agreement will be subject to the annual budget availability of each of the Parties and subject to their respective internal legislation.

Article 16

Both Parties to stimulate cooperation in the fields mentioned in this Agreement, without prejudice to the rights and obligations that both Parties derive from other international agreements they have signed, and compliance with the standards of the international organizations of the respective parties.

Article 17

The Parties decide to set up a Joint Commission in charge of the application of this Agreement It corresponds to the Joint Commission to guarantee the application of the provisions of this Agreement, to promote the approval of bilateral programs of educational and cultural cooperation according to how the issues that may be analyzed are analyzed. arise in the development of the Convention.

The coordination in the execution of this Agreement in everything related to the activities and meetings of the Joint Commission and the possible bilateral programs will be carried out by the following authorities of the Parties:

  • – On behalf of the Kingdom of Spain, the Ministry of Foreign Affairs, European Union and Cooperation.
  • – On behalf of the Republic of Senegal, the Ministry of Foreign Affairs and Senegalese Abroad.

The Joint Committee is composed of representatives of the competent bodies of the subsequent Parties to meet there, periodically and alternately, in Spain and in Senegal, determines the date and agenda of the meeting through diplomatic channels.

Article 18

Any dispute regarding the interpretation and application of the provisions of this Agreement shall be resolved through consultation and negotiation between the parties.

Article 19

The Parties, by mutual agreement, may introduce additions and modifications to this Agreement in the form of separate protocols that form an integral part of this Agreement and that will enter into force in accordance with the provisions contained in article 20 below.

Article 20

This Agreement enters into force on the date of the last written notification exchanged between the Parties, through diplomatic channels, reporting the same compliance with the internal procedures required for its entry into force.

This Agreement will have a duration of five years, automatically renewable for successive periods of equal duration, unless either Party notifies, in writing and through diplomatic channels, the other Party of its desire not to renew it, six months in advance. expiration of the corresponding term.

The Cultural Agreement between Spain and the Republic of Senegal, of June 16, 1965, is repealed on the date of entry into force of this Agreement.

The termination of this Agreement will not affect the validity or the duration of the activities or programs agreed under this Agreement until its termination.
