Dear Mr. Khare,

On January 28, 2009, Spain and the United Nations entered into an international agreement to provide support to United Nations peacekeeping and related operations.

In this regard, I wish to seek the consent of the United Nations to add to Article XXVI of the Agreement a third paragraph that stipulates the following:

3. Notwithstanding the provisions of section 1 of this article, civil servants included in the scope of application of this Agreement may voluntarily join the Spanish Social Security system.

I propose that, upon receipt of your written confirmation of the above, this exchange of letters constitutes an agreement between the United Nations and Spain amending the 2009 agreement.

This Agreement is provisionally applied upon receipt of your confirmation, and will enter into force the day following the date of receipt of the last of the notifications by which the parties reciprocally inform each other of compliance with their corresponding formal requirements, of accordance with its internal regulations.

I have the honor to refer to the Agreement between the United Nations and the Kingdom of Spain regarding the use by the United Nations of premises in the Kingdom of Spain for the provision of support to United Nations peacekeeping and related operations, signed on January 28, 2009 (the Agreement).

I also have the honor to refer to the Administrative Agreement between the United Nations and the Ministry of Defense of the Kingdom of Spain regarding the use by the United Nations of premises located in Valencia (Spain), signed on March 16, 2009, in under which the United Nations will maintain a support base in Valencia, Spain to support its peacekeeping and related operations.

I also wish to refer to the corresponding communications between the United Nations and the Government of the Kingdom of Spain (the Government) on the modification of the Agreement proposed by the Government to allow United Nations officials to voluntarily integrate into the social security system of the Kingdom of Spain, without prejudice to the fact that, in accordance with Article XXVI, paragraph 1, of the Agreement, they are exempt from any mandatory contribution to said regime for the duration of their employment at the service of the United Nations.

I am referring, in concrete terms, to the map of the Minister of Foreign Affairs, European Union and Cooperation sent to the United Nations on June 13, 2022 (the map of the Government), which requests the consent of the Organization to modify the Agreement adding to article XXVI a third paragraph with the following tenor:

3. Without prejudice to the provisions of paragraph 1 "supra", the officials included in the scope of application of this Agreement may voluntarily benefit from the Spanish social security system.

In addition, in the Government's letter it proposes that, once the written confirmation of the Government's proposal has been received from the United Nations, this exchange of letters already constitutes an agreement between the Organization and the Kingdom of Spain that modifies the Agreement and applies provisionally from the receipt of said confirmation, and which will enter into force the day after the date on which the last of the notifications by which the United Nations and the Kingdom of Spain inform each other of the conditions of compliance with their respective internal obligations for the ratification.

In this regard, and by virtue of the provisions of Article XXIX, paragraph 3, of the Agreement, I have the honor to confirm that the United Nations accepts the aforementioned Government proposal and that the Government's letter, like the present letter, constituting a Agreement between the United Nations and the Kingdom of Spain amending the Agreement, which is applied on a provisional basis and enters into force in accordance with the provisions of the letter from the Government.
