Another approach might be to first apply for a PPP loan, use payroll benefits for the applicable 8 weeks to pay yourself, and then apply for unemployment benefits after the PPP funds are exhausted. But again, no government body has provided any guidance regarding this course of action. LCA will continue to update this FAQ as the situation continues to evolve.

Before the federal CARES Act was enacted, a W-2 employee in Illinois was entitled to 26 weeks of benefits after losing their job. The CARES Act lengthened the period in which a worker entitled to benefits can get them from 26 to 39 weeks. It also provided an additional $600 in weekly benefits for those receiving regular unemployment benefits, and provided an additional 13 weeks of unemployment benefits for those who had previously exhausted their unemployment benefits.

The pandemic unemployment assistance portion of the CARES Act recognizes the plight of laid-off workers who are not employed, and provides certain benefits through the unemployment compensation system.

If you currently have a conventional loan—one backed by Fannie Mae or Freddie Mac—and you're unemployed, you'll likely need proof of your new job and future income before you can refinance your loan.

However, you still must meet the two-year history rule. If a temporary worker can document that he has consistently received unemployment payments for at least two years, this may be considered when applying for a mortgage.

While unemployment income can be averaged over the past two years as well as year-to-date, the lender must verify income from a current job in the same field. This means that he must be employed at the time of applying.

For this to work, your monthly disability payments—whether from your own long-term disability insurance policy or from Social Security—must be scheduled to continue for at least three more years.

Once again, you will need to show that the monthly payments are scheduled to continue for three more years. You may also need to show that you have been receiving payments regularly for the last two years.

The documentation required for each source of income is described below. Documentation must support receipt history, if applicable, and amount, frequency, and duration of receipts. Note: Any income received by the borrower in the form of virtual currency, such as cryptocurrencies, is not eligible to be used to qualify for the loan. For those types of income that require sufficient remaining assets to establish continuity, those assets cannot be in the form of virtual currency.

Review payment history to determine eligibility for stable qualifying income. To be considered stable income, full, regular and timely payments must have been received for six months or more. Income received for less than six months is considered unstable and cannot be used to qualify the borrower for the mortgage. Also, if full or partial payments are made inconsistently or sporadically, income is not acceptable to qualify the borrower.

For people who are self-employed or seasonal, or those experiencing a job gap, applying for a mortgage can be an especially harrowing experience. Mortgage lenders like easy employment verification and a few years of W-2s when considering a home loan application, because they consider them less risky than other types of employment.

But as a borrower, you don't want to be penalized for not having a job when you're confident in your ability to repay a home loan, or if you want to refinance your mortgage to lower monthly loan payments. Smaller loan payments can be especially helpful if you've recently lost your job and are worried about your monthly budget.

Buying or refinancing your mortgage while you're unemployed isn't impossible, but it will take a little more effort and creativity to meet the standard refinancing requirements. Unfortunately, lenders don't usually accept unemployment income as proof of income for your loan. There are exceptions for seasonal workers or employees who are part of a union. Here are some strategies you can use to help you obtain or refinance your loan without a job.
