Law 2/2023 on whistleblower protection has been published in the BOE, which transposes Directive (EU) 2019/1937 on Whistleblowing or "complaints channel".

It becomes mandatory to grant people who work in the private or public sector the possibility of reporting any irregular practice of which they are aware, ensuring the protection of the whistleblower from suffering any retaliation.

What entities are obliged to implement it?

-All companies that have 50 or more workers hired and all those regardless of the number of workers dedicated to services, products and financial markets, transport safety and environmental protection.

-All public administration and public sector entities regardless of size.

-Political parties, unions, business organizations and funds that manage public funds.

What happens if I don't comply?

-You will face economic fines ranging between 1.001 and 300.000 euros, in the case of natural persons; and 100.000 and one million euros, in the case of legal persons.

-And also to criminal and reputational risks, since not having a reporting channel would be considered that your crime prevention plan is not implemented correctly and is not a proof of the entity's criminal liability.
