Article 24 of Royal Decree 738/2015, of July 31, which regulates the activity of electrical energy production and the dispatch procedure in the electrical systems of non-peninsular territories, establishes that the General Directorate for Energy Policy and Mines will annually approve the value of the annuity of the compensation for investment (CIn) corresponding to each one of the category A facilities that have recognized the additional compensation regime for that year. Pursuant to the provisions of the cited article, the annual compensation for investment is made up of compensation for amortization and financial compensation.
Likewise, Royal Decree 738/2015 indicates in its eleventh transitory provision 3:
Category A electricity production facilities that, prior to the entry into force of the aforementioned royal decree, had their investment value recognized, would maintain the remuneration effects of said investment value until the end of their life until the regulation. Additionally, it establishes that the amortization method of the investment of these plants is maintained until the end of their regulatory useful life in accordance with the regulations in force prior to the entry into force of the aforementioned royal decree and based on the accumulated accumulation that would have been recognized to the entry into force thereof. And finally, it indicates that the values corresponding to said plants are included in its annex XVI.
The norm that regulated the cushioning of the investment of the facilities until the entry into force of Royal Decree 738/2015, of July 31, was Order ITC/914/2006, of March 30, which establishes the method of Calculation of the power guarantee remuneration for the generation facilities in the ordinary regime of the insular and non-mainland electrical systems.
On the other hand, in the calculation of financial remuneration, in accordance with article 27 of the aforementioned Royal Decree 738/2015, of July 31, the financial remuneration rate will be extended into consideration, which will be reviewed for each regulatory period by virtue of the provisions of articles 21 and 28 of the meritorious royal decree, the second regulatory period comprising the period between January 1, 2020 and December 31, 2025.
In this way, section 2 of the sole article of Royal Decree-Law 17/2019, of November 22, which adopts urgent measures for the necessary adaptation of remuneration parameters to the electrical system and which responds to the process of cessation of activity of thermal generation plants, sets the rate of financial compensation to apply to all installations of isolated electrical systems in non-peninsular territories category A that have investment compensation during the second regulatory period at 5% .
After the mandatory term of hearing, and by virtue of the foregoing, this General Directorate of Energy Policy and Mines, resolves:
nick. Establish the values of the annual compensation for investment (CIn) for the year 2023 for category A installations of the electrical systems of the non-peninsular territories, which will be those present in the annex to this resolution.
Contrary to this resolution that does not end the administrative route in accordance with the provisions of article 112 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, an appeal may be filed with the owner of the Secretary of State for Energy, within a month from the day following the publication of this resolution.
After said period has elapsed without having filed the appeal, the resolution will be firm for all purposes. For the calculation of the terms by months, the provisions of article 30 of the aforementioned Law 39/2015, of October 1, must be followed.
